Old Mout Merchandise Prize Draw Terms & Conditions - 2024
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this Promotion all participants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.
The personal data provided by entrants will only be used by the Promoter for the purpose of conducting the Promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at www.heineken.co.uk/legal-hub/heineken-brands-privacy-policy). From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the Promotion and contacting entrants (as necessary) and/or fulfilling the prize(s).
2. No Purchase Necessary to enter. To take part click the link, scan the QR code or click through from the relevant Old Mout Cider Moutoupia marketing asset or social media post to be taken to https://www.oldmoutcider.co.uk/moutopia_giveaway and input your first name, last name, email address on the entry form, tick the box to confirm your acceptance of the Promotion terms and conditions and click the “spin” icon on the wheel. Entry is limited to one entry per person per week during the Promotion Period as defined at condition 4 below. Your standard network rates apply.
3. Entries must be made personally. Entries made through agents/third parties, bulk entries or automated entries are invalid. Multiple entries in excess of the limit set out in condition 2 will be invalid. The Promoter accepts no responsibility for lost, incomplete, illegible or delayed entries, such entries will be void. Proof of entry is not proof of receipt and the Promoter does not accept any responsibility for the non receipt or the late receipt of any entries due to network or website failure or for any associated costs to entrants. No entries submitted via any other means will be accepted. The Promoter cannot guarantee uninterrupted or secure access to the web entry route. Any mechanical reproduction or automated entries is prohibited, and any use of such automated devices will cause disqualification.
4. The Promotion begins at 06:00 on 03/06/2024 and ends at 23:59 on 31/08/2024 (the “Promotion Period”). All entries must be submitted within the Promotion Period.
5. All entrants who validly enter the Promotion will have the chance to win a prize. Prizes will be allocated at random throughout the Promotion Period via an independently audited and verified winning moment programme. The entrant who enters the Promotion, in accordance with condition 3, at the time closest to one of the winning moments will win. There will be 13 winning moments per day of the Promotion Period. Any unclaimed prizes will be placed into a prize draw which shall take place at the end of the Promotion Period (the “Final Prize Draw”). The Final Prize Draw prizes will be allocated at random to entrants that have not already won. on 14/09/2024. All winners will be notified via email to the email address with which their entry was made and toclaim their prize, must complete the form within the email including their postal address & email address within 5 days of receipt. It is the winner’s responsibility to ensure that correct details are submitted. If winners do not complete the form within 5 days of receipt the Promoter reserves the right to re-draw and select new winners (and so on until winners can be contacted who will take up the prizes). Where the Promoter has made reasonable efforts to award all prizes, but has been unsuccessful in contacting winners who will take up all the prizes by 14/10/2024, the Promoter reserves the right to stop re-drawing winners and close the Promotion.
6. The Promoter reserves the right to verify all entries and the winners and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has gained unfair advantage in participating in the Promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into.
7. The winners will be instantly notified if they have won. To claim their prize, winners will be taken to an online form to input their postal address and re-enter the email address that was used upon their entry into the Promotion on the relevant form. It is the winner’s responsibility to ensure that correct details are submitted. Winners must immediately complete the form upon being notified they have won the Promotion. If the winner does not immediately complete the form upon receipt, the Promoter reserves the right to void the entrant’s entry and place the unclaimed prize in the Final Prize Draw. No entrant may win more than one prize.
8. Prizes: There are 600 Old Mout Cider branded bucket hats and 410 pairs of Old Mout Cider branded socks to be won. One prize per winner allocated at random. These prizes cannot be exchanged, refunded or resold. Winners’ details (first name, second name and postal address) will be shared with our fulfilment partner, Delta Fulfilment, throughout the Promotion Period for the purpose of facilitating the delivery of the prize to each winner’s postal address. By entering, the winners consent to such information being disclosed upon request. Prizes will be posted to winners that have provided their postal address in accordance with condition 6 within 14 days of receipt by Delta of the postal details.
9. There is no cash or other alternative to these prizes in whole or in part. Prizes are not transferable. The Promoter reserves the right to reclaim the prize if it is transferred.
10. The decision of the Promoter in all matters is final and binding and no correspondence will be entered into.
11. The Promoter is not responsible for any third party acts or omissions.
12. The Promoter reserves the right to cancel or amend this Promotion due to events or circumstances arising beyond its control.
13. All conditions, warranties and representations expressed or implied by law or otherwise in connection with the prizes are excluded to the fullest extent permitted by law and the Promoter shall be under no liability whatsoever or however in connection with any loss, damage or injury suffered as a direct result of the provision of the prizes. Promoter makes no attempt to exclude or limit its liability for death or personal injury arising as a result of its negligence. The prizes are manufactured by Logo International Ltd and supplied by Delta Display Limited trading as the Delta Group.
14. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Snapchat. Facebook and Snapchat are not responsible to entrants in respect of any aspect of this promotion.
15. All taxes (including without limitation national & local taxes) in connection with any prize & the reporting consequence thereof, are the sole responsibility of the prize winner.
16. These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law. The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.
